Terms and Conditions of our Online Store UNITRAILER.IE as of 25.02.2021

 

I.  Definitions

For the purpose of these Terms and Conditions, the following terms shall have the following meanings:

1. Customer – natural person, legal person or organisational unit not having legal personality, to whom legal capacity is granted, and who makes an Order over the Online Shop.

2. Consumer – Pursuant to article 22[1] of the Polish Civil Code shall mean any natural person who performs acts in law which are not directly connected to his economic or professional activity.

3.  Civil Code - Act dated 23 April 1964 (Polish Journal of Laws of No. 16, item 93 with later amendments;

4.  Terms and Conditions – the present Terms and Conditions specifying the rules of providing online services within the unitrailer.co.uk online shop.

5.  Online Shop (Shop) – online service available at unitrailer.co.uk, through which the Customer is able to place Orders.

6.  Goods – goods offered over the Online Shop.

7. Sales Contract - any contract for the sale of Goods within the meaning of the Polish Civil Code, concluded between UNITRAILER SP. z o.o. and the Customer with the use of the Online Shop.

8.  Consumer Rights Act – the Act dated 30 May 2014 on the rights of consumers (Polish Journal of Laws of 2014, item 827).

9.  Electronic Services Act – the Act dated 18 July 2002 on the provision of electronic services (Polish Journal of Laws no. 144, item 1204 with later amendments).

10.  Order – Customer's declaration of will that leads directly to signing of a Sales Contract, describing in particular the type and number of Goods.

 

II.  General provisions

2.1. The present Terms and Conditions specify the principles for using the Online Shop available at unitrailer.co.uk.

2.2.  The present Terms and Conditions are considered regulations in the meaning of Article 8 of the Polish Act on Providing Services by Electronic Means.

2.3. The online shop available at: unitrailer.ie is run by  UNITRAILER sp. z o.o. ul. Budowlana 30, 20-469 Lublin, Poland, under National Court Register (KRS) number 0000624998 and Polish VAT registration number (NIP) PL5213739921.

2.4.  The present Terms and Conditions lay down in particular [depending on availability]:

a)  rules for creating and using a user account in the Online Shop.  

b)  rules and conditions for making reservations for products available in the Online Shop.

c)  rules and conditions for making Orders in the Online Shop.

d) rules for concluding Sales Contracts with the use of services provided in the Online Shop.

2.5. The use of the Online Shop is possible only if the computer system used by the user fulfils the minimum technical requirements: IE 7 or later, FireFox 3 or later, Opera 9 or later, Chrome 10 or later, Safari with the latest JAVA and FLASH versions, screens with resolution exceeding 1024 px.   

2.6. In order to use the Online Shop, the Customer should obtain access to a computer or a device with Internet access.

2.7.  Pursuant to laws in force, UNITRAILER Sp. z o.o. reserves the right to limit its services to adults only.

2.8 Customers have access to these Terms and Conditions at any time and can access them by means of a reference link found on the main page of unitrailer.ie, as well as hold the right to download and print it.

III. Terms of Use for the Online Shop 

3.1. In order to avail of all services of the Online Shop, the Customer is required to register in the shop.

3.2 In order to register, the user must fill and accept the registration form available on one of the pages of the Online Shop.
3.3. To register successfully, the Customer must accept the Terms and Conditions as well give all information marked as necessary.
3.4. In case of violation of the present Terms and Conditions, UNITRAILER sp. z o.o. may withdraw the Customer's right to use the Online Shop as well as limit his or her access to parts or all of the resources of the Online Shop with immediate effect, particularly if the Customer:

a) submitted personal details which are untrue or outdated, misleading or violating the rights of any third party,
b) infringed personal interests of a third party by means of the Online Shop, especially personal property of other Customers of the Online Shop,
c) performed other actions that UNITRAILER Sp. z o.o. deems non-compliant with the law in force and general terms of use, or undermining the reputation of UNITRAILER sp. z o.o

3.5. A person who has lost the right to use the Online Shop, cannot register again without obtaining the prior consent of UNITRAILER sp. z o.o.

3.6. To guarantee the safety of data and communication with respect to the services provided within the webpage, the Online Shop undertakes technical and organisational measures to provide the safety of use, especially measures that prevent unauthorised acquisition and modifications of personal data submitted via unitrailer.ie.

3.7. The Customer is, in particular, obliged:
a) to refrain from submitting and communicating forbidden content, i.e. promoting violence and violating personal rights and other rights of a third party,
b) to use the Online Shop in a way that does not interfere with its functioning, in particular by using certain software or devices,
c) not to undertake actions such as: sending or submitting unwanted data,
d) use the On-line store in a way that is not burdensome for other Customers and for UNITRAILER sp. z o.o.,
e) use the content submitted by the Online Shop for personal purposes only,
f) use the Online Shop according to the law in force of the Republic of Poland, provisions of these Terms and Conditions and general rules for using the Internet.  

IV.  Procedure for concluding a Sales Contracts

4.1. It is by means of product descriptions, specifications and prices that Customers are invited to purchase goods within the meaning Article 71of the Polish Civil Code.

4.2 In order to be able to conclude the Sales Agreement through the Online Shop, the Customer must enter unitrailer.ie and select goods and follow the displayed instructions and information.
4.3 To select Goods, the Customer need to add them to the basket.

4.4 Until the Customer presses the "Place your Order" button, he or she has the right to modify the selected Goods and other data. For this purpose, the Costumer should follow the displayed instructions.

4.5 After submitting all the necessary information, an Order summary will be displayed for the Customer. An Order summary includes the following information:
a) the ordered products,
b) unit price and total price for the ordered products or services, including shipping costs and additional costs (if applicable),
c) the chosen payment method,
d) the chosen shipping method,
c) the time of delivery.

4.6. For the Order to be shipped, the Customer must accept the Terms and Conditions, submit his personal details marked as obligatory and press "Place your Order".
4.7. Placing an Order by the Customer is a declaration of will to sign a Sales Contract with UNITRAILER Sp. z o.o, in accordance with the content of the Terms and Conditions.
4.8. After placing an Order, the Customer receives an e-mail containing the final confirmation of all important Order details.
4.9. The Sales Contract is deemed complete upon receipt of the aforementioned e-mail by the Customer.
4.10. The Sales Contract is concluded in English and its content is consistent with the Terms and Conditions.

4.11. The customers can access the present Terms and Conditions at any time.

4.12. Data pertaining to all Orders and the General Provisions (of the present Terms and Conditions) are preserved, secured and shared via electronic mail.

V.  Delivery process

5.1. The  Goods are delivered to the provided delivery address.

5.2. The entire delivery process takes between 3 to 14 working days.

5.3. The Products are delivered by means of freight forwaring companies such as GLS or DPD. The cost of delivery can be verified by clicking at the basket while placing an order.

5.4. The order completion date is 1-14 business days  from the purchase date.

 

VI.  Prices and payment methods

6.1. The prices are given in  EUR (€)and include 23% VAT.

6.2. The Customer may avail of the following payment methods

a) money transfer to the following bank account PL52 1050 1953 1000 0090 3145 0209, ING Bank Śląski, SWIFT/BIC: INGBPLPW,

b) VISA/MasterCard/PayPal.

VII.  The right to withdraw from the Agreement

7.1 The Customer has the right to withdraw from the Agreement within 30 days. The Customer has the right to withdraw from the present Agreement within 30 days without stating a cause. After 30 days from the day of receiving the orders Goods, the Customer no longer enjoys the right to withdraw from the Agreement.

7.2 To avail of the right to withdraw from the Agreement, the Customer must inform UNITRAILER sp. z o.o. ul. Budowlana 30, 20-469 Lublin Poland, mail: unitrailer@unitrailer.ie on his or her decision to withdraw from the Agreement.

7.3 To retain the right to withdraw from the Agreement, the Customer must state his or her intention to exercise the right before the withdrawal period has expired.

7.4 Aftermath of Agreement cancellation

If you withdraw from the above Agreement terms, we shall reimburse all amounts received, including the costs of delivery (with the exception of supplementary costs resulting from your decision to choose a delivery method other than the least expensive delivery method offered by the website), shall immediately, and in any event not later than 14 days after the termination of the contract, inform us about the intention to withdraw from the provisions of the above Agreement. We will carry out such reimbursements by means of the same payment method as the one used by Customer, unless the Customer agrees otherwise; in any event, the Customer will not incur any additional charges.

7.5. We may may not provide reimbursements until we receive the goods back or the Customer has supplied evidence that the goods have been returned.

7.6. The purchased products should be returned to: Magazyn UNITRAILER, ul. Budowlana 30, 20-469 Lublin, Poland. The return should be made immediately, not later than 14 days after withdrawing from the terms of the Sales Agreement. 

7.7.  If the Customer withdraws from the Agreement, he or she must send back the Goods at his or her expense and risk.

VIII. Complaints

8.1.  UNITRAILER sp. z o.o bears liability towards the Customer within the meaning of Article 221 of the Polish Civil Code, under statutory warranty for physical defects of the products set forth in Articles 556, 556[1]-556[3] and successive of the Polish Civil Code.

8.2. Complaints resulting from the violation of Customer rights granted by law or resulting from these Terms and Conditions should be sent to unitrailer@unitrailer.ie. UNITRAILER sp. z o.o shall respond to all complaints within 14 days. If the complaint is not looked into within this period, the complaint must be deemed justified.

8.3. In case of Goods that are not manufactured by UNITRAILER sp. z o.o, the Producer is responsible for all warranty-related queries under conditions specified in the product's warranty booklet. The Customer may submit his or her claims, as part of the warranty, directly to the authorised service point, the address of which can be found on the warranty card.

IX Complaints about internet services

9.1. UNITRAILER sp. z o.o undertakes to provide the proper functioning of the Online Shop and commits itself to remove all irregularities reported by the Customers within a reasonable period.

9.2. The Customer is obligated to report any irregularities or interruptions in the proper functioning of the Online Shop.

9.3. All malfunctioning website features can be reported in writing to: UNITRAILER Sp. z o.o. ul. Budowlana 30, 20-469 Lublin, Poland, unitrailer@unitrailer.ie or via contact form.

9.4. The complaint shall include the Customer’s name and surname, the address for correspondence, type and date of the irregularity related to the functioning of the Online Shop.

9.5. UNITRAILER sp. z o.o undertakes to look into the complaint within 14 days. If it is not considered within this period, the complaint shall be deemed justified.

 X.  Consumer disputes and final provisions

10.1. The Customer enjoys the right of recourse to an out-of-court complaint, to which the trader is subject.  All disputes linked to online shopping may be resolved through mediation process conducted by Regional Inspectorates of Trade Inspection (Wojewódzkie Inspektoraty Inspekcji Handlowej) or through proceedings before The Arbitration Court of Regional Inspectorates of Trade Inspection. The Customer may choose other out-of-court complaint resolution methods and, for instance, submit his complaint via the EU ODR platform available at: http://ec.europa.eu/consumers/odr/

10.2. If the Consumer does not wish to avail of his or her right to an out-of-court complaint resolution method, all potential disputes between UNITRAILER sp. z o.o   and the Customer shall be resolved in accordance to the Polish Code of Civil Procedure, by the competent court.

10.3. The resolution of disputes between UNITRAILER sp. z o.o and the Customer shall be referred to the competent court with respect to the headquarters of UNITRAILER sp. z o.o.

10.4. To all matters not settled in the present Terms and Conditions, the provisions of the Polish Criminal Code concerning online services and other relevant provisions shall apply.
